Austrian UID (VAT ID): ATU78942156

2. Conclusion of Contract
The presentation of products in our online boutique does not constitute a legally binding offer, but rather an invitation to place an order (invitatio ad offerendum).
By clicking the button "Authorize Order" in our checkout dialog, you submit a binding offer to purchase the goods in your dining bag. You will receive an automated order confirmation via email immediately after transmission. The legally binding contract of sale is concluded either when we transmit a formal dispatch confirmation or when the goods are dispatched from our Vienna atelier.
3. Prices, Austrian Value Added Tax (VAT) & Currency
All consumer prices are quoted in Euros (EUR) and include statutory Austrian Value Added Tax of 20% (Mehrwertsteuer - MwSt.), unless indicated otherwise.
Shipping costs, insurance against transit breakages, and courier handling fees are displayed distinctly in your cart breakdown prior to final order submission. Complimentary courier delivery applies automatically to qualifying orders exceeding €250 within Austria and the European Union.
4. Payment Methods & Processing
We offer the following secure payment mechanisms:
- EPS Online-Ăśberweisung: The verified Austrian inter-bank payment standard for instant secure authorization.
- Credit Cards: Visa, MasterCard, and American Express with 3D-Secure authentication.
- Apple Pay & Google Pay: Encrypted biometric payments.
- Corporate Invoice (Firmenrechnung): Available exclusively to verified companies with an active Austrian or EU UID number, payable net 14 days.
5. Retention of Title (Eigentumsvorbehalt)
In accordance with § 1063 ABGB, all delivered goods remain the unencumbered property of FineDine Shop Handelsgesellschaft m.b.H. until full payment of the invoice amount, including all incidental courier fees, has been irreversibly credited to our bank account.
6. Statutory Warranty (Gewährleistung) & Product Guarantees
Statutory warranty provisions under Austrian law (§§ 922 ff ABGB) apply:
- For consumers (Verbraucher im Sinne des KSchG), the statutory warranty period is 2 years from the date of handover.
- In the rare event of transit damage or manufacturing defect, please contact our Vienna concierge within 48 hours of receipt with photographic documentation so we can arrange immediate white-glove replacement or courier collection.
- Natural variations in mouth-blown crystal, hand-thrown porcelain glazes, and wood grains are inherent hallmarks of artisanal craftsmanship and do not constitute defects (see our Disclaimer).
7. Applicable Law & Legal Venue
The contractual relationship shall be governed exclusively by the laws of the Republic of Austria, excluding its conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
For disputes arising with commercial entities (Unternehmer im Sinne des UGB), the competent court having jurisdiction over 1010 Wien, Austria (Handelsgericht Wien) is agreed as the exclusive venue. For private consumers residing in Austria or the EU, statutory mandatory jurisdictions pursuant to § 14 KSchG and the Brussels I Regulation (recast) remain untouched.
